內容提要：
違憲審查并非唯一的憲法實施方式，憲法的全面貫徹實施還需關注和重視其他實施方式。除了違憲審查、憲法遵守、依憲立法等方式之外，我國憲法還可以而且應當在普通的法律適用中通過“依憲釋法”的方式得以實施，這是當下中國憲法實施的重要途徑。廣大司法者和行政執法者在適用法律處理具體案件時，應當開展“依憲釋法”，即依照憲法的規定及其精神來解釋所要適用的法律條款，使憲法在法律適用中得以間接實施。法律適用中的憲法實施，可讓中國憲法在當下廣泛實施起來，并有利于維護法制的統一，有助于憲法文化的建構，應當予以高度重視。
The constitutionality review is not the only way of the implementation of the constitution,the full implementation of the Constitution also needs to focus on and highlight other implementation methods.In addition to constitutionality review,compliance of constitution and legislation according to constitution,the constitution of our country also can and should be implemented by "interpretation according to the constitution" in the application of law.It is an important method for the implementation of the Constitution in present China.All of the judiciary and administrative law enforcement in the treatment of law applicable to specific cases,should carry out "interpretation according to the constitution",in accordance with the provisions of the Constitution and the spirit to interpret the law to be applicable,the Constitution can be implemented in the application of law.The implementation of the Constitution in the application of law can make our Chinese Constitution widely implemented in present and is helpful to preserve consolidation of legal regime and construction of constitutional culture.We should attach great importance to it.

憲法的生命在于實施。我國現行憲法公布實施30多年來，應該說在國家經濟、政治、文化和社會生活中發揮了重要的作用。但同時也要看到，憲法的實施狀況還存在不盡人意的地方，一些不同程度的違憲現象仍然存在。憲法的全面貫徹實施，還需要全社會作出進一步的努力。憲法的實施是我國法學界一直關注和研究的熱點問題。對于憲法的實施，長期以來法學界一直重點關注違憲審查，強調違憲審查是憲法實施的保障，這無疑是正確的。然而，違憲審查不是憲法實施的唯一方式，對于憲法實施的其他方式，我們同樣必須予以充分重視，只有這樣才能“把全面貫徹實施憲法提高到一個新水平”。為此，本文擬討論法律適用中的憲法實施問題，探究當下中國的憲法實施之門，以期為我國憲法的全面貫徹實施提供一種思路和理論支持。
