　　內(nèi)容提要：依法推進(jìn)政府職能轉(zhuǎn)變的提出，是基于以往歷次政府職能轉(zhuǎn)變主要是依靠權(quán)力和關(guān)系在體制內(nèi)封閉進(jìn)行，缺少法制的剛性約束，導(dǎo)致不斷反復(fù)。推動國家治理現(xiàn)代化使破解這一難題有了突破口，即政府職能轉(zhuǎn)變作為實(shí)現(xiàn)國家治理現(xiàn)代化的必然要求，必須納入國家治理法治化軌道，運(yùn)用法治思維和法治方式，在法律框架內(nèi)進(jìn)行，通過建立和完善行政法律規(guī)范體系，合理規(guī)范權(quán)力運(yùn)行，建設(shè)善治意義上的治理服務(wù)型法治政府，以更好地體現(xiàn)現(xiàn)代國家治理所內(nèi)蘊(yùn)的現(xiàn)代法治精神，加速向現(xiàn)代國家轉(zhuǎn)型，并在這個過程中不斷依法解決國家治理現(xiàn)代化中的各種問題，更好地體現(xiàn)制度的正義和自信。

　　To promote the transition of government function,put forward in accordance with the law,is based on any past government function transformation mainly rely on the power and the relationships within the system closed,lack of the rigid constraints of the legal system and lead to constant.The modernization of national governance a breakthrough in the problem of crack is put forward,namely the change of government function as to realize the requirement of the modernization of the national governance,the orbit must be included in the national governance,using the rule of law thinking and way of the rule of law,the legal framework,through establishing and perfecting administrative law system,the reasonable standard power operation,the construction of service-oriented government under the rule of law,good governance in the sense of governance in order to better reflect the intrinsic spirit of modem rule of law,modem state governance to accelerate the transformation to modem countries,and constantly in the process in accordance with the law to solve the various problems in modernization of governance,to better reflect the justice system and self-confidence.

　　依法推進(jìn)政府職能轉(zhuǎn)變的提出，是基于以往歷次政府職能轉(zhuǎn)變主要是依靠行政權(quán)力在體制內(nèi)封閉進(jìn)行，改來改去總是回到原點(diǎn)。盡管依法治國和依法行政也提出好多年，法律體系日臻完備，但由于延續(xù)千年的傳統(tǒng)人治影響根深蒂固，司法權(quán)威性不足，實(shí)際發(fā)揮作用的還是行政手段，政府對資源的絕對壟斷反而越來越嚴(yán)重，直至固化，束縛著體制外市場和社會功能的發(fā)揮。這種做法在推進(jìn)國家治理現(xiàn)代化階段不僅不能再繼續(xù)沿用，甚至還是巨大障礙。黨中央將“全面推進(jìn)依法治國”視為治理國家的基本方略和“推進(jìn)國家治理體系和治理能力現(xiàn)代化”的“重要保證”，提出“依法全面履行政府職能”，使政府職能轉(zhuǎn)變按照依法治理要求被納入法治軌道，真正有了實(shí)質(zhì)性突破的可能。
